• MEDIATION AND INFORMATION SESSIONS :
1- La Family mediation: To encourage its use, the Québec Department of Justice covers the fees of accredited family mediators, provided the situation meets the established criteria. See all the details : https://www.justice.gouv.qc.ca/en/couples-and-families/separation-and-divorce/family-mediation-negotiating-a-fair-agreement
2- Free information session on parenting after separation : Parenting after separation information sessions are provided free of charge. They give parents an opportunity to deal with their break-up and prepare questions for the person who will help them settle the details of their separation, whether as part of the family mediation process or during a court hearing. See details : https://www.justice.gouv.qc.ca/en/couples-and-families/separation-and-divorce/family-mediation-negotiating-a-fair-agreement/free-information-session-on-parenting-after-separation
3- Mediation at the Small Claims Division : Mediation services are available at the Small Claims Division to help the parties resolve their dispute by reaching a settlement. No additional charge is made for mediation. Once you have filed an application at the Small Claims Division, you become entitled to use the mediation services. If you agree to pursue mediation, the defendant is informed and is free to accept, or not to accept, the offer of mediation. You can request mediation at any time prior to the hearing, even if you or the defendant have previously rejected the offer of mediation. To request mediation, you must file a written application at the court office. Mediation sessions are private and informal. Once both you and the defendant have agreed to mediation, you are called to a meeting with the mediator (a lawyer or notary) at a time that is convenient for you. Each session lasts about an hour. During the mediation session, the mediator invites both parties to present their respective situation, and tries to guide them toward a settlement.
Starting on May 15, 2015, all applications concerning a consumer contract filed at the Small Claims Division of the Civil Chamber of the Court of Québec in the judicial districts of Gatineau and Terrebonne are subject to a pilot project on mandatory mediation. The mediation session is provided to the parties free of charge, and must take place before the case can be heard by the court.
The Québec Department of Justice also provides information on private civil and commercial mediation as well as on citizen mediation. See all the détails : /https://www.justice.gouv.qc.ca/en/your-disputes/dispute-prevention-and-resolution-dpr-processes/mediation/citizen/
• ALTERNATIVE MEASURES PROGRAM FOR ADULTS IN ABORIGINAL COMMUNITIES :
The Program applies exclusively to Québec’s Aboriginal population. The Program aims, in particular, to promote stronger involvement by Aboriginal communities in the administration of justice. It offers people who have been accused of a criminal offence an opportunity to take part, if they agree, in a supervised reconciliation and reparation process as part of the judicial proceedings. In general, an Aboriginal community must have established a justice committee before its members can benefit from the Program. • COURT-SUPERVISED DRUG TREATMENT PROGRAM:
The Québec court-supervised drug treatment program will offer a way for the court system to reduce the level of crime associated with drug addiction using penal measures that support treatment for addicts as a way to protect society. As permitted by the Criminal Code, the program will give the courts the ability to suspend a sentence until the addicted offender undergoes a court-supervised treatment for his or her addiction. The program will also enable closer cooperation between the courts and addiction resources to establish courses of treatment, including therapy, rehabilitation and social reintegration.
